By making a payment to Fractional Creatives, you acknowledge that you have read, understood, and agree to be bound by these Payment Terms of Service.

Description of Services

Fractional Creatives provides strategic brand, marketing, and communication solutions through our fractional partnership model. Services include but are not limited to: integrated marketing and communications strategy, strategic brand development and management, creative design and production, digital marketing and advertising, and sales enablement support.

By making payment, you confirm that you understand the scope of services outlined in your project proposal, statement of work, or retainer agreement, and that you are authorized to make payment on behalf of your organization.

Payment Terms

Deposits - Project deposits are typically 50% of the total project value and are required before work commences.

Project-Based Payments - Milestone payments may be structured as payment plans based on project deliverables and timelines as outlined in your project agreement.

Retainer Payments - Monthly retainer fees are due at the beginning of each billing period. Additional ad-hoc projects may incur separate charges beyond the base retainer rate.

Payment Methods - We accept e-transfers and EFTs (preferred), credit cards, and wire transfers. For EFT and wire transfer payments, please contact us for banking details.

Refund Policy

Deposit Policy - All deposits are non-refundable once work has commenced, regardless of project status or completion.

No Refunds For Completed Work - Fractional Creatives does not offer refunds on completed services or delivered work.

Value Concerns - In rare circumstances where clients feel they did not receive adequate value from our engagement, we are willing to discuss the matter on a case-by-case basis. Any resolution is at the sole discretion of Fractional Creatives.

Cancellation Policy

Project Cancellation - Projects may be cancelled at any time. Upon cancellation, an invoice will be issued for all work completed up to the cancellation date. Deposits remain non-refundable.

Retainer Cancellation - Ongoing retainer agreements require a minimum of 30 days written notice for cancellation. The final invoice will cover work completed during the notice period.

Payment Obligation - Cancellation does not relieve you of payment obligations for services already rendered or work in progress at the time of cancellation.

Delivery and Timeline

Service delivery timelines vary based on project scope and complexity as outlined in individual project agreements. Digital deliverables are provided electronically through secure file sharing platforms or email.

All work is delivered digitally. No physical products are shipped.

Force Majeure

Fractional Creatives shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, government restrictions, internet outages, or other unforeseeable events. In such cases, performance will resume as soon as reasonably possible.

Limitation of Liability

Fractional Creatives' total liability for any claims arising from our services shall not exceed the amount paid by you for the specific services giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

No Guarantee of Results

While we provide professional strategic and creative services with the goal of improving your business outcomes, Fractional Creatives makes no guarantees regarding specific business results, including but not limited to increased sales, market share, brand recognition, or return on investment.

Intellectual Property

Upon full payment, you will receive usage rights to work created specifically for your organization. Fractional Creatives retains the right to showcase completed work in our portfolio and marketing materials unless otherwise agreed in writing.

Dispute Resolution

Any payment disputes must be raised within 30 days of the invoice date. We encourage direct communication to resolve any concerns before pursuing formal dispute procedures with financial institutions.

Governing Law

These terms are governed by the laws of Alberta, Canada and any disputes will be resolved in the courts of Alberta.

Modifications

Fractional Creatives reserves the right to modify these Payment Terms of Service at any time. Updated terms will be effective for all future transactions.
